PLEASE READ ALL of the following directions so that your claim is filed efficiently and correctly. Failure to provide all information will result in delays of the claim process.

Dear Consumer,

The satisfaction of our customers are of the utmost importance to us, and unfortunately sometimes there are issues that may arise that must be addressed by our consumer service representatives. We sincerely apologize that you are having an issue with your mattress, and we will go above and beyond to service you in a prompt and timely manner.

**If you have moved more than 50 miles away from our store, you must deal directly with the manufacturer. You will need to go to their Offical Website to fill out a warranty claim and let them you have moved.

If our store no longer carries the particular brand you have, you will have to go to their Offical Website to get service as we no longer have an account with them, therefore, they will not send the replacement to us.

Please read these instructions before filling out the warranty form so that you may fill it out correctly and submit it to get your claim started.

Guidelines of Mattress Warranty:

Traditional innerspring/quilted top mattresses:

Body impressions of up to 1-1/2" on quilted traditional mattresses are considered normal wear and tear over the warranty period. (usually 10 full years) If you have measured 1-3/4" or more then that would meet the guideline. Side breakdowns, innerspring breakage of any kind under normal wear and tear.(Jumping on a mattress concentrates weight into one area and can cause breakage of the innerspring unit and is not covered)

Memory foam or Hybrid model mattresses:

Body impressions of up to 3/4" on memory foam or Hybrid models are considered normal wear and tear over the warranty period. (usually 10 full years) If you have measured 1" or more then that would meet the guideline.

The following items must be submitted in addition to your claim form.
1. Copy of invoice (proof of purchase) If you no longer have your original receipt, the store location may be able to provide one for you. Keep in mind, these records are only required to be saved for 3-5 years. We will do our best to find it. (Any items that hold a manufacturer's warranty must have a proof of purchase. Retail stores are not required to save your receipts)

**2. Informaiton from the original Law Tags (The Law Tag is attached to the head of the mattress and should not to be removed as they show the date of manufacture and important information on the mattress.) If you have removed these tags and do not have them, unfortunately the manufacturer cannot identify the mattress as having a valid warranty period, and it will be null and void. If you do have the law tag, take complete pictures of front and back of the tag.

3. Photos: Please provide photos of defective area of the mattress. **Please see examples below. If you are having body impression issues, make sure to remove all bedding and use a straight edge ruler or broom handle to lay across the mattress and measure the gap between the hande and the mattress. Be sure not to push down on the measuring tape into the mattress and do not measure in a button stitch/ stitch pattern which are there to tack down materials and should already be 1/2" indented. Take an up close picture of the measurement and also a picture of the whole bed showing all the edges of the mattress with the measurement & handle on it.

4. Download and PRINT this form. Fill out all information. Compose an email uploading the completed form AND the pictures required. Once we recieve the email, we will contact you back achknowleging we have recieved all the items needed. We will then forward them to the manufacturer. Normal turn around time is approx. 5 business days to recieve an approval or denial. The manufacturer will send us the replacement. If your mattress is still in-line, you will get the same one, if not, you will get the most recently updated version. You have 100% of your credit to use. If that same item costs more due to increased costs in materials, you just pay that difference. If you choose to pick somethng else entirely, you will have 75% credit of what you paid originally to use. If you choose something that is more expensive, you just owe that difference. There is no store credit or money back if you choose not to use the entire credit. Comfort exchanges do not apply on warranty replacements.

Please keep in mind, the following items are NOT covered:
1. Transportation to your home and/or service costs associated with the warranty process: The warranty covers the replacement of the defective item or items. Transportation costs are as low as $79.95 but could be more depending on your delivery area. *See store for details.

2. Mattresses found to be stained in any way, deemed unsanitary or abused condition.

3. Normal wear and tear reflected in the guidelines of the warranty.

4. Replacement of the set when only one piece is found to be defective.

5. Comfort of the mattress. ex: hurts your back, hip etc. too soft, too firm etc. Our store provides a 120 night and up to a 365 night comfort trial for this specific problem and is not covered under any manufacturer's warranty.

By using the website, you signify your consent to these terms of use. If you do not agree to these Terms of Use, please do not use the website.

Your access to and use of this website, as well as all related websites operated by (Mattress Direct Alcoa) and .com (collectively the “Site”) is subject to the following terms and conditions (“Terms of Use”) and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, the Terms of Use and acknowledge that any other agreements between you and the Site are superseded and of no force or effect:

  1. You agree that you will pay for all products you purchase through the Company website. You are responsible for the payment of all fees, such as delivery fees, processing fees on exchanges, as well as Tennessee state sales tax. Prices for products offered by the Company may change at any time, but the Company DOES provide a 15 day price protection or refunds in the event of a price reduction or promotional offering. If a product becomes unavailable following a transaction but prior to your purchase, your sole remedy is a refund, which will be provided. If technical problems, shipping issues, or back ordered items prevent or unreasonably delay delivery of your product, your exclusive and sole remedy is either a replacement, loaner or refund of the price paid, as determined by the Company. We do not refund on any products that have been shipped, delivered or excepted. You have an option of an exchange on select items limited to mattresses but NOT including accessories such as pillows, sheets, protectors etc. We offer our exclusive 365 Night Comfort Trial comes with premium mattress purchases only, all others are 120 Nights, with exceptions of closeout, discontinued and/or sold "as is" models, such as floor model closeouts. Those exceptions have an "all sales final" stipulation. Any exchanges must be stain and odor free and there is a $149 processing fee assessed on all exchanges to cover transportation costs. This fee can change at anytime due to increases in fuel and labor costs. There are no exchanges on any adjustable bases, as those are a permanent purchase. If you are opting in for the Free Power Base Event, that promotion is only available with MLily, Therapedic and Malouf brands so any mattress exchanges must be with those brands to recieve full credit on the exchange. If you choose another brand to exchange to, you will recieve a 75% credit to use, due to the promotion being limited.

  2. Our Rewards program is exclusive to our store, and you can cancel your monthly subscrption at anytime. Points are earned as dollars spent. Whenever you purchase an item accessory such as pillows, sheets, protectors, you earn points for every dollar you spend. If you purchase a mattress you earn 10 pts per dollar you spend. (purchase a mattress for $1500 you earn 150 points to use towards your next one) You must have your subscription a minimum of one full year for our "Free Premium Sheets or Pillows every year" and you will receive those on your one year anniversary. If you decide to cancel within the year, the cycle will complete at your one year anniversary and not be renewed. Please email us at mattdirectalcoa@aol.com to cancel and please make sure you give your name, phone number and address in the email. If you have earned points/cash before your cancelation, those can still be used up to 6 months after the final billing cycle.

  3. You agree that the Site itself, as well as all content, videos, training materials, products, services and/or other materials, made available on the Site by us or other third parties, as well as the look and feel of all of the foregoing, (collectively referred to as the “Content”) are maintained for your personal use and information by (Mattress Direct Alcoa) (the “Company”) and are the property of the Company and/or its third party providers. You agree that such Company Content shall include all proprietary videos, HTML/CSS, Javascript, graphics, voice, and sound recordings, artwork, photos, documents, and text as well as all other materials included in the Site, excluding only the materials you provide. Subject to your compliance with these Terms of Use, the Company hereby grants you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the Site solely for your personal purposes. No Company Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by the Company. Any unauthorized use of Content may violate the copyright, trademark, and other proprietary rights of the Company and/or third parties, as well as the laws of privacy and publicity, and other regulations and statutes. Nothing contained in this Agreement or in the Site shall be construed as granting, by implication or otherwise, any license or right to use any Trademark or other proprietary information without the express written consent of the Company or third party owner. The Company respects the copyright, trademark and all other intellectual property rights of others. The Company has the right, but has no obligation, to remove content and accounts containing materials that it deems, in its sole discretion, to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Use.   6. While the Company uses reasonable efforts to include accurate and up-to-date information in the Site, the Company makes no warranties or representations as to its accuracy. The Company assumes no liability or responsibility for any errors or omissions in the content of the Site.

When you register with the Company and/or this Site, you expressly consent to receive any notices, announcements, agreements, disclosures, reports, documents, communications concerning new products or services, or other records or correspondence from the Company. You consent to receive notices electronically by way of transmitting the notice to you by email.

  8. If you send comments or suggestions about the Site to the Company, including, but not limited to, notes, text, drawings, images, designs or computer programs, such submissions shall become, and shall remain, the sole property of the Company. No submission shall be subject to any obligation of confidence on the part of the Company. The Company shall exclusively own all rights to (including intellectual property rights thereto), and shall be entitled to unrestricted use, publication, and dissemination as to all such submissions for any purpose, commercial or otherwise without any acknowledgment or compensation to you.

  9. The Company shall use commercially reasonable efforts to restrict unauthorized access to our data and files. However no system whether or not password protected can be entirely impenetrable. You acknowledge that it may be possible for an unauthorized third party to access, view, copy, modify, or distribute the data and files you store using the Site. Use of the Site is completely at your own risk.

  10. The Company will not intentionally disclose any personally identifying information about you to third parties, except where the Company, in good faith, believes such disclosure is necessary to comply with the law or enforce these Terms of Use. By using the Site, you signify your acceptance of the Company’s Privacy Policy. If you do not agree with this Privacy Policy, in whole or part, please do not use this Site.

  11. NEITHER THE COMPANY NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR MAINTAINING THE SITE AND/OR ANY CONTENT ON THE SITE SHALL BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO OR USE OF THE SITE. ANY SUCH PROBLEM SHALL BE GOVERNED SOLELY BY THE AGREEMENT BETWEEN YOU AND THAT PROVIDER. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, RELIANCE OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT, INCLUDING, BUT NOT LIMITED TO, DAMAGE OR LOSS OF PROPERTY, EQUIPMENT, INFORMATION OR DATA, LOSS OF PROFITS, REVENUE OR GOODWILL, COST OF CAPITAL, COST OF REPLACEMENT SERVICES, OR CLAIMS FOR SERVICE INTERRUPTIONS OR TRANSMISSION PROBLEMS, OCCASIONED BY ANY DEFECT IN THE SITE, THE CONTENT, AND/OR RELATED MATERIALS, THE INABILITY TO USE SERVICES PROVIDED HEREUNDER OR ANY OTHER CAUSE WHATSOEVER WITH RESPECT THERETO, REGARDLESS OF THEORY OF LIABILITY. THIS LIMITATION WILL APPLY EVEN IF THE COMPANY HAS BEEN ADVISED OR IS AWARE OF THE POSSIBILITY OF SUCH DAMAGES.

  14. If your purchase includes calls with the Company, you are responsible for scheduling them. All bookings are non-refundable. If you have to cancel your call, please email (mattdirectalcoa@aol.com) with the subject "CALL CANCELLATION- [date & time of your call]" no less than 48 hours before your call. If you do not show up to your call or reschedule within 48 hours, you forfeit your call.

  15. You agree to indemnify and hold the Company and each of its directors, officers employees, and agents, harmless from any and all liabilities, claims, damages and expenses, including reasonable attorney’s fees, arising out of or relating to (i) your breach of this Agreement, (ii) any violation by you of law or the rights of any third party, (iii) any materials, information, works and/or other content of whatever nature or media that you post or share on or through the Site, (iv) your use of the Site or any services that the Company may provide via the Site, and (v) your conduct in connection with the Site or the services or with other users of the Site or the services. The Company reserves the right to assume the exclusive defense of any claim for which we are entitled to indemnification under this Section. In such an event, you shall provide the Company with such cooperation as is reasonably requested by the Company.

  16. The provisions of these Terms of Use are for the benefit of the Company, its subsidiaries, affiliates and its third party content providers and licensors, and each shall have the right to assert and enforce such provisions directly or on its own behalf.

  17. This agreement shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any principles of conflicts of law. You further submit to the exclusive jurisdiction of the state and federal courts sitting in Orange County, Florida. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
